By using NEMIX TOURNAMENT ("the Service") you fully accept these Terms of Service. If you do not accept these terms, you may not use the Service. The Service is provided by Massamba Diane, VAT IT05183680239, based in Italy.
NEMIX TOURNAMENT is a commercial SaaS Discord bot for managing Battle Royale tournaments (Call of Duty Warzone; Fortnite and Apex Legends coming soon). The Service includes: - Discord bot with tournament management commands - Web dashboard for advanced management - License and subscription system - NEMIX Vision, included in Plus plans - Free Player Area on nemixbot.com: player profiles, clans and the global Leaderboard
To use the Service you need to: - Have a valid Discord account - Purchase a license via nemixbot.com - Link the license to your Discord ID using the !activate command The license is personal and non-transferable. You may activate the bot on a number of servers equal to your purchased plan.
The current plans and prices are those published on nemixbot.com at the time of purchase; changes apply from the next renewal, subject to prior notice. The 14-day free trial is not part of a purchase: it starts on its own in the server when you create the first tournament there (!setupticket or from the dashboard), with no card and every feature, Plus included. Buying a plan charges right away, at the time of purchase.
Payments are managed via Stripe. Subscriptions renew automatically at expiration. You can cancel at any time from the Stripe customer portal accessible from the Account page. In case of failed payment, the Service is suspended after a grace period. No refunds are provided for partially used periods, unless otherwise agreed.
This section covers anyone taking part in a tournament run with NEMIX, whether or not the tournament has an entry fee. By registering for a tournament, a participant's in-game nickname and results — kills, placements and match statistics — are displayed publicly in the standings on Discord and on nemixbot.com, including after the tournament has ended. The tournament organizer is responsible for informing their participants of this visibility before they register. For removal requests: [email protected] Results also flow into the global NEMIX Leaderboard on nemixbot.com (by nickname, with Preseason scores computed from history). Linking nicknames and statistics to a Discord account happens only with the player's explicit, revocable consent (claim); photos and data appearing in broadcast graphics require a separate, opt-in consent. Clan pages are user-generated content: the clan owner is responsible for the published name, description and images.
This section covers only tournaments with an entry fee organized by users of the Service. It does not cover NEMIX subscriptions, which are governed by sections 4 and 5. Collecting entry fees Entry fees are collected through Stripe Connect and are destined to the Stripe account that the organizer connects to their own Discord server. Without a connected Stripe account the fee cannot be collected. The organizer is the holder of that account and of the resulting contractual relationship with Stripe. Roles and responsibilities NEMIX provides the collection and calculation tools and retains a 5% service commission on the amount of every transaction collected through Stripe. The prize pool is collected by the organizer, who is solely responsible for it: redistribution to participants, tax obligations, authorizations and compliance with the regulations applicable in their own country. NEMIX does not hold the prize pool and does not pay prizes to winners. Prize distribution At the end of the tournament NEMIX calculates the amounts due for each placement and presents them to the organizer. Payment to the winners is executed by the organizer from their own account: the Service does not send money. The organizer then confirms in the dashboard that the payment has been made. Refunds Refunds of entry fees are handled by the organizer through the tools provided by the Service, on a single registration or on the whole tournament in case of cancellation. The refund returns the full amount paid to the participant, NEMIX commission included. Refunds are subject to Stripe's operating conditions: once the funds have been transferred to the organizer's bank account, the outcome of a refund may depend on the balance available in their Stripe account. Requests to refund an entry fee must be addressed to the tournament organizer, not to NEMIX. PayPal payments If the organizer provides a PayPal contact, payment takes place outside the Service: it is not verified automatically, it must be confirmed manually by the organizer and it falls outside the commission flow. This option may be changed or removed at any time.
The 14-day free trial starts on its own when the first tournament is created in the server (!setupticket or from the dashboard): it requires no card or payment details and includes every feature, Plus included. It is available once per server and per account (Discord ID and/or email). Attempts to reuse the trial via different accounts or servers are considered abuse of the Service and result in the trial being ended immediately.
You may not use the Service to: - Organize prize money tournaments without the necessary legal authorizations - Engage in illegal activities or violate Discord's Terms of Service - Attempt to bypass the license or authentication system - Resell or sublicense the Service to third parties - Any use that damages NEMIX or other users
All code, design, logos and content of NEMIX TOURNAMENT are the exclusive property of Massamba Diane. Copying, modification or distribution without written authorization is prohibited.
The Service is provided "as is". We do not guarantee continuous availability. We are not responsible for: - Loss of tournament data caused by malfunctions - Indirect or consequential damages from use of the Service - Interruptions caused by Discord, Stripe or other third-party services Our maximum liability is limited to the amount paid in the last month of service.
We reserve the right to suspend or cancel an account in case of: - Violation of these Terms of Service - Non-payment - Fraudulent or abusive activity In case of cancellation due to violation, no refund is provided.
We reserve the right to modify, update or discontinue the Service at any time. Material price changes will be communicated with at least 30 days notice via email.
These Terms are governed by Italian law. For any dispute, jurisdiction lies with the consumer's place of residence (if an individual) or Milan (if a business).
